3. Repair Services Disclaimer
All repair, maintenance, performance modification, and diagnostic services are performed based on professional judgment and manufacturer specifications where applicable. Motorcycles and performance vehicles involve inherent mechanical risks. The Company does not guarantee that any repair, modification, or service will prevent future mechanical failure. Performance modifications may affect reliability, manufacturer warranties, emissions compliance, and road legality. It is the customer’s responsibility to ensure compliance with applicable laws.
4. Estimates and Authorization
All estimates are approximations only. Additional issues discovered during repair may require additional parts and labor. No work will be performed without customer authorization. Authorization may be provided in writing, electronically, or verbally (where permitted by law). Customer is responsible for payment of all approved repairs.
5. Limitation of Liability
To the maximum extent permitted by Texas law: The Company’s total liability for any claim arising out of services provided shall not exceed the total amount paid by the customer for the specific service giving rise to the claim. Under no circumstances shall the Company be liable for:
• Indirect damages
• Incidental damages
• Special damages
• Consequential damages
• Loss of use
• Loss of income
• Towing expenses
• Rental costs
• Diminished value
• Emotional distress
• Punitive damages
This limitation applies to all claims, whether based in contract, negligence, tort, strict liability, or otherwise.
6. Warranty Disclaimer
Unless expressly stated in writing, the Company makes no warranties, express or implied, including but not limited to:
• Warranties of merchantability
• Warranties of fitness for a particular purpose
If a workmanship warranty is provided, it will be documented separately in writing and limited to the specific repair performed. Manufacturer warranties on parts are subject solely to the manufacturer’s terms.
7. Storage and Abandoned Vehicles
Vehicles not retrieved within 7 days of notification of completion may be subject to daily storage fees. Vehicles left beyond 30 days without communication may be considered abandoned and subject to disposal in accordance with Texas law, including mechanic’s lien rights. The Company is not responsible for loss or damage due to fire, theft, weather, or acts beyond its reasonable control.
8. Payment Terms and Return Policy
All services and parts are sold on a prepaid basis. Payment in full is required at the time of authorization and prior to the ordering of any parts or commencement of work. No work will begin without full payment.
Labor and Services
All labor charges and completed services are final and non-refundable once performed.
Parts Policy
All installed parts are non-refundable. Uninstalled parts may be eligible for return only if:
• The part is unopened, unused, and in original manufacturer packaging
• The return request is made within two (2) business days of the original invoice date
• The part is not a special-order, custom, electrical, performance, or non-returnable item
Approved returns are subject to a thirty percent (30%) restocking fee. Special-order, custom, performance, electrical, and non-returnable items are final sale and not eligible for return under any circumstances. Refunds, if approved, will be issued in the original form of payment, less applicable restocking fees.
Order Cancellations
Because all orders are prepaid and parts are ordered immediately upon authorization, cancellations after parts have been ordered are not permitted. If cancellation is approved at the Company’s sole discretion, restocking fees of up to thirty percent (30%) or actual supplier-imposed fees, whichever is greater, will apply.
Chargebacks
Customer agrees not to initiate chargebacks or payment disputes for authorized services or parts. Any billing concerns must be submitted in writing within five (5) business days of invoice date to allow an opportunity for resolution. The Company reserves the right to retain possession of any vehicle until payment is received in full and may exercise mechanic’s lien rights as permitted under Texas law.
9. Intellectual Property
All website content, branding, logos, and materials are protected by intellectual property laws. “3CM” is a trade name owned by 3CMWERX INC and licensed to 3rd Coast Motowerx, LLC. No use of logos or branding is permitted without written authorization.

11. Governing Law and Venue
These Terms and any dispute arising from services or website use shall be governed by the laws of the State of Texas. Any legal action shall be brought exclusively in the state or federal courts located in Harris County, Texas.
